Since 1948, the ILO has taken measures to promote and protect freedom of association and the obligations of governments to respect the rights and freedoms of unions. However, some of these measures have been consistently opposed by governments. The purpose of this paper is to criticize the approach and basis of the ILO in obligating governments to respect freedom of association. The ILO is based on the doctrine of implied powers and has interpreted its constitution in accordance with its goals and objectives, thereby establishing the Committee on Freedom of Association. This action of the ILO is in contrast to the 1969 Vienna Convention. The doctrine of originality should be placed on the interpretation of the constitution, and the constitution should be given a restricted interpretation. The basic nature of freedom of association is a human right, and if we analyze it in this regard, public order will restrict its scope of application in practice.
