Relevant components of privacy have been divided into four topics (categories), even though there is no equal definition of it. Topics include physical privacy, personal life privacy, privacy related to a person’s identity, and occupational privacy. Nowadays, modern information and communication technologies threaten privacy. For instance, information superhighways such as the Internet have prepared new ways for infringement of privacy. On the one hand, the Internet facilitates access to personal data and distortion and destruction of them, as well as exploitation of a person’s identity and publication of this information for unauthorized purposes; and on the other hand, tracking information relevant to a person’s identity and also the content of sent messages is possible through the Internet. Furthermore, publishing some information on the Internet results in the creation of nominal files or behavioral data banks, and any number of a person’s information and all other Internet users’ identity elements become—visibly or invisibly—accessible and exploitable in various ways. Meanwhile, when setting rules supervising the protection of privacy, little consideration has been given to this new technology. In the IT era, the issue of privacy protection has taken a new form within the framework of data protection, and it includes a new conception of the right to privacy. Consequently, every piece of information having a private aspect—like physical, audiovisual information, sexual relationships, philosophical, religious, and political beliefs, racial and ethnic roots, and even interests—should be legally protected as soon as they are processed through electronic data. In Iran, from the legal point of view, the necessity of protecting personal data, particularly after the disclosure of the private life details of an actress through the Internet and mobile devices, has been recognized more than ever. This article has been compiled with the purpose of considering principal contents concerning the privacy of personal data, the evolution of legislation in this matter, and the study of Iran and EU rules about personal information and the legal limits of personal data protection.
