The pattern of the Iranian governmental system is simple, based on which political power belongs to a single legal entity called the central government, located in Tehran, the capital city of Iran. In addition, administrative systems in governmental organs are centralized, and Tehran serves as the center for administrative and bureaucratic processes, such as operational and technical affairs, at different levels of state divisions. Legal delocalization of Tehran has been less discussed among legal and management experts, the public, and high-ranking authorities of Iran. To achieve the delocalization of Tehran, the constitutional capacities can be utilized in the operational phase, so there is no need to ratify and implement temporary plans such as relocating employees or governmental organs from Tehran. Proper delocalization should pursue important objectives such as increasing local community responsibility, reducing administrative bureaucracy, enhancing citizens’ participation in planning and development processes, promoting balanced development, ensuring fair allocation of resources, and, on the other hand, guaranteeing the fundamental rights of people as expressed in laws and regulations, particularly the Iranian Constitution concerning citizenship rights. This research seeks to examine the legal capacities that are imposed upon the government as constitutional obligations and to propose them as solutions for Tehran’s delocalization. It emphasizes implementing these existing laws and regulations by the government to avoid the need for new legislation. The main purpose of this research is to present effective legal solutions and mechanisms, based on Iran’s legal capacities, for the legal delocalization of Tehran while protecting citizens’ fundamental rights. This research is descriptive, analytical, and practical.
