چکیده

ماده 678 ق.م یکی از طرق ارتفاع وکالت را عزل موکل می داند. از مقایسه این ماده با ماده 186 و 954 ق.م این نتیجه حاصل می شود، که وکالت عقد جایز است. در کتب فقهی نیز رای به جواز این عقد داده شده است. ماده 680 ق.م مقرر می دارد، که اراده صرف موکل مبنی بر عزل برای پایان یافتن وکالت کافی نبوده، بلکه وکیل باید از عزل خبردار شود. در این مقاله ابتدا به بررسی سابقه فقهی موضوع سپس به نظر نفوذ یافته در قانون مدنی سپس مبنا و قلمرو حکمی و موضوعی ماده 680 ق.م می پردازیم.

Article 678 of the Civil Code considers removal of the agent one of the ways of termination of agency. A comparison of articles 186 and 954 of the Civil Code leads to the point that agency is a revocable contract. Revocability of this contract is also recognized in Jurisprudential texts. Article 680 of the Civil Code provides that the mere decision of the principal concerning removal is not enough for the termination of agency and the agent should be informed about it. The present article studies the jurisprudential background of the issue, its influence on the relevant articles in the Civil Code, and the foundation and domain of the matter of the law and the matter of the fact of Article 680 in the Civil Code.
