The foundation of the contract has a considerable effect on the interpretation of the conditions of validity, their position in the contract, and their influence in Iranian law. This research examines the impacts of the foundations of contracts on the essential conditions for their validity. Are the essential conditions for the validity of contracts a predetermined pattern established by the legislator or divine sources, which must exist in all contracts because they are deemed necessary by them? Or, in the absence of these conditions, is the will of the parties undermined and the consideration incomplete? Or are the essential conditions for the validity of contracts necessary for maintaining order in society and ensuring stable transactions? We aim to answer these research questions. The essential conditions for the validity of contracts may be based on individualism, social necessity, legalism, or solely divine will.
