Defensive rights are the legal collection that the accused has in the process of trial to establish a fair trial, and is required by the criminal justice system. These rights are largely synonymous with the concept of a fair trial, and in fact a fair trial, the accusation of defending the rights of defense. These rights have been regarded as sacred, and in the quadruple sources of inference of judgments (book, tradition, consensus, reason) expressly or implicitly expresses some of these rights, such as the principle of innocence, independence and impartiality, respect for the dignity and dignity of individuals, Publicity, revision has been addressed. The purpose of this article is to study the position of the principles of fair trial in Islamic justice system and to study these principles in the Islamic law and the opinions and opinions of the jurists. برای آنکه اهداف قضا از نگاه اسلام، که اقامه قسط و عدل و احقاق حق می‌باشد محقق گردد، لازم است دادرسی از اصولی پیروی کند و در مراحل مختلف آن حقوق اصحاب دعوا به ویژه متهم و محکوم رعایت گردد. تحقق دادرسی عادلانه مستلزم رعایت حقوق دفاعی متهم در فرآیند دادرسی می‌باشد. حقوق دفاعی مجموعه حقوقی هستند که متهم در طی فرآیند دادرسی برای برقراری محاکمه‌ای عادلانه از آن برخوردار می‌باشد و رعایت آن توسط نظام عدالت کیفری لازم می‌باشد. ما در این تحقیق، به بررسی رعایت اصول دادرسی عادلانه در فقه امامیه پرداخته‌ایم. بر همین اساس نتایج به دست آمده نشان می‌دهد این حقوق مورد توجه شارع مقدس بوده است و در منابع چهارگانه استنباط احکام (کتاب، سنت، اجماع، عقل) به طور صریح یا ضمنی به بیان پاره‌ای از این حقوق مانند اصل برائت، استقلال و بی‌طرفی، رعایت کرامت و حیثیت اشخاص، علنی بودن، تجدیدنظرخواهی پرداخته شده است. https://ilr.isu.ac.ir/article_2380_7271a3b8c7352fafcf56962b2ca5810c.pdf
