Considering the deep influence of Muslim clergymen in the theoretical and practical development of society, study of the issue from this perspective is of high significance. Among the wide range of contemporary scholars, the socio-political performance and jurisprudential views of the late Akhund Khurasani in the constitutional era hold a particular position. Study of the issues relevant to parliament and the conditions of legislation in his view can lead to the development of legal as well as political concepts within the theoretical framework of the Islamic system. The present article focuses on this issue. موضوع وظایف مجلس و شرایط و قلمرو قانون‎گذاری در تاریخ معاصر کشور ما همواره در ارتباط با دو عنوان کلی دین و قلمرو آن از طرفی و مباحث مرتبط با حقوق عمومی و علوم سیاسی از سوی دیگر مطرح گشته است. در این میان با توجه به نفوذ و تأثیرگذاری عمیق دستگاه روحانیت و علما در تحولات نظری و عملی جامعۀ ما، بررسی موضوع از این نظرگاه از اهمیت خاصی برخوردار می‌باشد. در میان طیف وسیع علمای معاصر عملکرد سیاسی‎–‎اجتماعی و نظرات فقهی مرحوم آخوند خراسانی در دوران مشروطیت از جایگاه ممتازی برخوردار بوده و بررسی مسائل مربوط به مجلس و شرایط قانون‎گذاری از نظر ایشان می‌تواند به گسترش مفاهیم حقوقی و سیاسی در چارچوب نظری نظام اسلامی منجر گردد. بررسی این مسأله محور اصلی این مقاله را تشکیل می‌دهد. https://ilr.isu.ac.ir/article_1275_533263b48a319ecb9a40c06b5bd4b890.pdf
